Ball In DPP’s Court To Decide How Piarco Corruption Matter Will Go Ahead

It’s not the end of the Piarco Airport Corruption matter, as the DPP is to decide whether the two potential avenues to pursue fraud allegations against Brian Kuei Tung, Ishwar Galbaransingh, Steve Ferguson and others, will be followed.

Director of Public Prosecutions, Roger Gaspard SC, says apart from a new Preliminary Inquiry, Section 23 (8) (d) of the Preliminary Enquiries Act facilitates the by-passing of the preliminary enquiry stage, in cases involving serious complex fraud.

But, he notes he will consider many more factors, including the age of the matter and how much money the State has already spent, in making his decision.

Meanwhile, Minister in the Office of the Attorney General, Renuka Sagramsingh-Sooklal, says the State has already sought legal advice on the Piarco Airport Corruption matter, following Monday’s Privy Council ruling which found that Chief Magistrate Sherman McNicholls exercised “political bias” in committing those accused to stand trial.

The legal advice, presented by attorney Kerwyn Garcia, stated that “A discharge or dismissal of the preliminary enquiry is not an acquittal.”
