Legal Notice #75: Quarantine Defined Under TT Public Health Regulations

There have been further amendments to the Public Health Ordinance that were published in the Trinidad and Tobago Gazette, Legal Notice #75.

 The decision was taken at “Cabinet last night”, according to Attorney General Faris al Rawi who said that it is meant “to assist the courts in considering clarification based on litigation that has come forward during this COVID-19 crisis,” in a clear reference to the issue of quarantine as it applies to the Ian Alleyne matter and other litigation brought before the courts.

“Regulation Number 8 is a new regulation and is a direct importation of existing law. The law has been put into the regulations,”  the AG  explained at a news conference on Friday morning. (see image below)

“The power and function of the Chief Medical Officer (CMO) and the Minister of Health under the Public Health Ordinance in Section 105 (1) a and b allows the Minister of Health via the CMO to restrain, segregate and isolate the persons who are affected by COVID-19, in this case, and persons who are likely to be affected. It has a precise feature of law which provides for Quarantine that run alongside the Quarantine Act,” the AG said.
