Moderna to sue Pfizer-BioNTech over mRNA tech

Moderna is getting ready to take fellow vaccine developers Pfizer and its German partner BioNTech to court after alleging that the company infringed on patents related to mRNA technology.

The mRNA tech became popular in the production of COVID-19 vaccines and according to Moderna, Pfizer-BioNTech’s vaccine Comirnaty infringes on patents it filed between 2010 and 2016 related to the same methodology.

Moderna announced that they will sue Pfizer and its German partner BioNTech earlier today Friday, August 26.

“We believe that Pfizer and BioNTech unlawfully copied Moderna’s inventions, and they have continued to use them without permission,” said Moderna chief legal officer Shannon Thyme Klinger via a press release.

While the company has stated that it won’t enforce its COVID-19 vaccine patents in low- and middle-income countries, it does expect Pfizer, BioNTech and other vaccine makers to respect its intellectual property rights in other markets.
